Currently there is a slight issue with Msft when upgrading to an elite console: you lose your arcade games.
Well, technically you don't lose them. As long as you recover your gamertag and then download the games again (for free) you can play them as long as you're signed into that gamertag.
However, if you're offline, or signed into another profile, your arcade games will go to trials. So this means for anyone who does not have a connection where they're at - all your arcade games will be trials.
But why, you might ask? It's due to a liscensing issue, or Digital Media Rights management problem. You can't have full version arcade games on more then one console.
Normally, if you had an exchange at the store, or a repair on a unit with Msft, you could do a Points After Repair escalation by calling Msft customer support. It takes one week. The amount of points for your download are credited back towards a secondary profile and you can then download those games again. Upon re-download, they become re-associated with all your profiles again.
Not so with the upgrade to the Elite bundle. Why?
"When using the data transfer migration cable, there is a message that displays the text "SOME INFORMATION MAY NOT BE TRANSFERRED."" This is what customer support will tell you if you call them about it.
But guess what Microsoft? By using the data transfer migration cable it does not say you agree to those terms. It's just a caution message.
Lawsuits? More then likely.
