Sorry but once your console has been detected as banned you are banned and there is nothing you can do.

Why People Are Banned:
Many people on Xbox Live have been banned recently and no one really understands why. While there have been lots of people banned because they are hacking/modding there are still lots of people out there saying they have done nothing wrong.
People, what you are experiencing is guilt by association. If player 1 has a custom map that is against the terms of use and plays with player 2 and 3, even a few times or on a regular basis, when player 1 gets banned, so will player 2 & 3.
Xbox live works much like the old party lines used to work so when a spike of information comes over the to the server from a game, whoever is in that game, if the server determines modified hardware/software (like halo 2 maps) and bans because of this, it will not just ban one console.
The way Xbox Live works is like this - it's called Semantic Indexing. Each part of Xbox live consists of gamers who have their own groups. Say group 1 is playing on Live. Group 2 joins. But someone in group 1 has a modded map that is against ToU. The server would ban group 1 and group 2.
This is why many people out there who have been banned have friends or family who have been banned too - because the server bans based on association in some cases.

couple of my friends called xbox and canceled there account because of this bann
trust me microsoft has big system problems too when i called they said i am out of warranty
And after 30 mins talking they said i am in warranty and they gave me free repair
this can be system error too

Well I called Microsoft yesterday and spent 30 minutes on the phone with them and they told me to call the company that i purchased the XBOX360 from (Best Buy). I asked them what are they supposed to do for me and they said nothing.
So i decided to call back and spoke to one guy who was actually nice and then I talked to his supervisor who had no clue and just hung up on me which was probably the best example of customer service i have ever heard.
No one was able to tell me why I was banned from XBOX 360 Live. All they can do is say that I modified my console. Which I have not and have voluntarily offered to pay to ship my console out to WA to figure out why it was banned and pay the shipping back. They would not take me up on that offer.
Then I reached out to the major nelson and asked him for help which he replied that his security team and they said i was banned. I replied back to him wanting to know what was it that I did to my console to make me banned and have not heard back from him.
What I suggest people do is to contact the law firm of Keller Rohrback who is currently in a class action lawsuit against Microsoft about there Security Update from the Fall that caused systems to crash. Again this is another update that they have not thoroughly tested and is affecting people who have not modified there consoles.

Hey Phil,
please read the above post about what I have said about people being banned and not knowing why. Do you play halo 2?
Unfourtunately you are not the only person this has happened to; msft should draw the line somewhere in terms of who they ban but I think the problem mainly is the system they use to ban is an automatic flagging system and its not subject to an unban or an explanation why, other then a ToU violation.

Hi Terry but I have never played Halo 2 or Halo 3. I have contacted a law firm that is currently suing Microsoft for their patch that they released in September and they have now added me to the lawsuit. I have also contacted the Better Business Bureau of Washington because a company that bans someone better have the exact reason than just saying the Terms of Use Violation.
I have offered to send them my XBOX 360 to figure out why it was banned. I have brought my XBOX 360 to the place of purchase and they did an investigation and said it was not modified.
Microsoft will be losing this fight, I guarantee it.

Phil,
Please let us know what happens and what the outcome of the lawsuit is. Generally, when you're suing a big company like Microsoft, it can be held up in court for years before you see any resoloution. Often it costs a lot of money and a lot of lawyer bills before you'll get what you want.
I wish you good luck; but should the lawsuit take too long you're better off just buying another xbox 360 console, if you really want to play. The chances of two being banned are unlikely (espcially if you purchase one from another store).
